Welcome to the Evercast Presenter App (the "App"). These Terms of Use ("Terms") govern your access and use of the App. By accessing or using the App, you agree to these Terms. If you do not agree, you must discontinue use immediately.

You must be at least 18 years old and capable of entering into a legally binding agreement to use the App. By using the App, you represent that you meet these eligibility requirements.

3. License and Restrictions

3.1 License Grant

Evercast grants you a non-exclusive, non-transferable, revocable license to use the App for professional or personal video production purposes in accordance with these Terms.

3.2 Restrictions

You may not:

  • Modify, reverse engineer, or attempt to extract source code from the App.
  • Use the App for any unlawful, abusive, or unauthorized purposes.
  • Bypass or circumvent security features or usage limits set by Evercast.
  • Use the App in a manner that could disrupt Evercast’s services or servers.

4. User Responsibilities

4.1 Compliance

You are responsible for complying with all applicable laws and regulations when using the App.

4.2 Account Security

You are responsible for maintaining the security of your login credentials and all activities under your account.

5. Data Collection and Privacy

Evercast may collect and use data as outlined in its Privacy Policy. By using the App, you consent to such collection and use. Evercast does not claim ownership of your content but requires permission to process data necessary for the App’s functionality.

6. Intellectual Property

All rights, title, and interest in the App, including its trademarks, logos, and proprietary technology, remain with Evercast. Any feedback or suggestions you provide may be used by Evercast without obligation or compensation.

7. Updates and Modifications

Evercast may update, modify, or discontinue the App at any time without notice. Continued use of the App following changes to these Terms constitutes acceptance of the revised Terms.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. EVERCAST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERCAST SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10. Termination

Evercast reserves the right to suspend or terminate your access to the App at any time for violations of these Terms or for any reason at its sole discretion.

11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Arizona in the United States of America. Any disputes shall be resolved through binding arbitration in Arizona, except where prohibited by law.
